A recent blog in the Insurance Journal recently links Workers’ Compensation protection to 18th century pirates, 19th century worksite reform in Germany, and a 20th century tradeoff in New York Workers’ Compensation policies.

18th Century – The Beginning of Workers’ Compensation

Eighteenth century privateers (pirates) benefitted governments. A method of compensation for work-related loss of body parts encouraged laborers to pursue this line of work.

Programs in Germany, Europe and the United States

Germany’s Otto von Bismarck “Workers’ Accident Insurance” in 1881 resulted in similar programs in Europe and the United States. New York’s 1910 workers’ compensation laws met opposition and were overturned March 24, 1911.

The next day a business fire resulted in the deaths of 146 workers. Injured workers and surviving families were required to sue company owners for damages. Many families could not afford the costs of filing a civil suit. Additional complications also discouraged requests for damages.

New York State’s “Great Tradeoff” involved each side giving up certain demands and safeguards. Employees gave up the right to sue. Employers agreed to pay lost wages and medical bills regardless of fault. Employer-purchased Workers’ Compensation coverage assumed the risk.
